Initial 433 Eros Claim
Date: 03 Mar 2000
Level of Control:
Complete Control in "fee simple" or "outright ownership, free & clear" specifically not instituted on behalf of any Nation and regard it as real personal property owned by Gregory W. Nemitz, a Natural Person.
Basis for Making Claim:
The Near-Earth Asteroid, 433 Eros is a potential resource base for construction materials and propellants.
1.) As the Claimant having the highest property right to the entire asteroid 433 Eros by first claim;
2.) and in continuous pursuit of perfecting this claim hold it to this ownership standard:
Complete Control, "fee simple" or "outright ownership, free & clear"; and not
instituted on behalf of any nation; and recognized that 433 Eros is real property
owned by Gregory William Nemitz, a Natural Person;
3.) and to improve my equity property right by development of 433 Eros' tourist value, derived media rights, mining useful materials, creating useful sheltered volume, and the installation of essential development systems, remotely or in-situ;
4.) and to defend rights of this claim with prior objection to Adverse Possession by any other claimant.
Precise Description of Claim:
The entire asteroid, Eros. And a volume of space 50km in altitude into space from every point on the surface of the asteroid.
Purpose of Claim and Development Schedule:
Goals of the 50-Year Development Plan
On each pole of Eros' spin axis, the Project will dig two large caverns. One pit will house a spinning O'Neil colony city, which will be the inhabited capital city of 433 Eros. The city will be well shielded from solar radiation and be a comfortable place to live.
The other shielded pit will be used as a shipyard to construct hulls for additional O'Neil cities, large oxygen tankers, and spacecraft hulls. These products will be for sale.
Large solar concentrators will be used to smelt and refine materials. Export products are expected to be refined iron, magnesium, aluminum, potassium, oxygen and pure silicon. It is probable that platinum, gold, iridium, and other Rare Earths metals will be processed for export.
A corridor will be mined along the spin axis, which will become the main throughfare between the City and the Shipyard. As mining progresses, branch tunnels and caverns will be constructed for industry, storage, and recreation.

as real personal property owned by Gregory William Nemitz, a Natural Person.
Basis for Making Claim:
Gregory William Nemitz has personally appropriated into his previous claim for
433 Eros, the work-equity of the NEAR Shoemaker spacecraft, which was a work-equity
abandoned by the US government and NASA, thus was freely available for appropriation.
1.) As the Claimant having the highest property right to the entire asteroid 433 Eros by first claim;
2.) and in continuous pursuit of perfecting the prior claim by the infusion of substantial work-equity and hold all claims to this ownership standard:
Complete Control in "fee simple" or "outright ownership, free &
clear" specifically not instituted on behalf of any Nation and regard it
as real personal property owned by Gregory William Nemitz, a Natural Person.
3.) and to improve and develop the equity of the existing property right of 433 Eros' via the abandoned work-equity of a resource survey system, its activities and any derived media rights, remotely or in-situ;
4.) and to defend rights of this claim and others with prior objection to Adverse Possession by any other claimant.
Precise Description of Claim:
The entire in-situ work-equity created by the NEAR Shoemaker spacecraft project. This is the value of the existence of proof that useful materials exist on 433 Eros. Due to international Treaty restrictions, the US government and NASA were required to abandon this work-equity.
The estimated dollar value of the now recovered, abandoned work-equity is estimated to be $225,000,000.
